It's not just Trump's incompetency and corruption that played out here, this embarrassing failure belongs to Pam Bondi, Trump's consigliere. She owns this as well.
A federal judge threw out the criminal charges against James Comey, the former F.B.I. director, and Letitia James, New York’s attorney general, on Monday after finding that the prosecutor President Trump handpicked to bring the cases had been illegally appointed. The ruling deals a heavy blow to a pair of high-profile prosecutions sought by President Trump, who has pushed the Justice Department to pursue his political enemies.
He did so without prejudice. The tRump regime can bring charges again. Whether it does remains to be seen.

ReplyDeleteLes... not completely true. The statute of limitations on the Comey case has run out, ending any legal jeopardy for him. But Trump can refile on James.
ReplyDeleteAnother problem on this case comes from sworn testimony from a former prosecutor in this exact jurisdiction. That former prosecutor testified, under oath, that he was ordered by the Trump Admin to lie in court if he was asked about a memo he wrote saying "prosecution was not warranted for lack of actual evidence."
All of this stems from a view within MAGA land, openly supported in places like the Mothership and Trump himself, that simply "knowing" something, regardless of evidence or lack thereof, gives you the right to bring charges.
Even this last weekend Trump, when asked why he called certain members of Congress traitors, he said because he "believed" they were guilty. No evidence, just his superior intellect.
Don't y'all miss the days when a prez kept his eye on the economic and security ball... instead of settling old non existent scores?

ReplyDeleteAll of the legal wrangling from the Trump Admin is interesting. In a strict understanding, what we saw yesterday was that the judge decided that the Trump Admin had not followed Constitutional law in this case.
ReplyDeleteI'm wondering how our "Constitution Lovers" who typically inhabit the MAGAverse feel about all the Trump Admin cases being thrown out of court by the judicial branch?
After all, judges appointed by President Reagan, Bush, Clinton, Bush, Obama, Biden and yes... wait for it... Trump, have agreed multiple times. The Trump Admin has repeatedly acted outside of the Constitution.
Why?
The authoritarian is doing what his hero, Adolph did. Inculcate (Americans) with lies and illegal actions knowing that eventually they will be accepted as the norm.

ReplyDeleteTrump was indicted because he is a criminal.
Comey and James were indicted because Trump is a criminal.
The larger question for Americans is whether the Trump Admin is actually respecting and following the rulings of the federal judiciary.
ReplyDeleteIn this, there can be no wiggle room. Hamilton wrote in Federalist 78, upon which our Constitution rests, that "the complete independence of the courts of justice is peculiarly essential in a limited Constitution."
Not partial independence, not a lot of independence, but rather "complete independence".
Hamilton goes on...
"...this quality [complete judicial independence] may therefore be justly regarded as an indispensable ingredient in its constitution, and, in a great measure, as the citadel of the public justice and the public security."
Why is this important to remember? Because whenever the Trump Admin denigrates and ignores judicial orders, it is essentially ignoring our Constitution, which it has sworn to "preserve, protect and defend".
When due process is ignored, as it has been multiple times by ICE, the admin ignores the Constitution.
When laws are ignored, as was done with the prosecution of Comey and James, the admin ignores the Constitution.
When Secretary Noem ignored judicial orders to not send immigrants to be tortured in a prison in El Salvador and return them home, the admin ignores the Constitution.
And the list can go on and on.
Because the Trump Admin and their MAGA supporters, including their voting public enablers and members of the House and Senate GOP, don't really care about, or support the Constitution, or believe in law and order.
They just prefer to talk about.
Authoritarians care nothing for the restraints that protect the people from their authoritarian excesses and abuses of power. They obviously prefer theDivine Rights of Monarchs to our democratic Constitutional Republic.
