Supreme Court Sides With Wrongly Deported Migrant

 





NYTimes:  “The ‘evidence’ against Abrego Garcia consisted of nothing more than his Chicago Bulls hat and hoodie,” she wrote, “and a vague, uncorroborated allegation from a confidential informant claiming he belonged to MS-13’s ‘Western’ clique in New York — a place he has never lived.

 The U.S. Court of Appeals for the Fourth Circuit, in Richmond, Va., refused to pause Judge Xinis’s ruling, likening Mr. Abrego Garcia’s deportation to an act of official kidnapping."

“The United States government has no legal authority to snatch a person who is lawfully present in the United States off the street and remove him from the country without due process,” wrote Judge Stephanie D. Thacker, who was appointed by Mr. Obama. “The government’s contention otherwise, and its argument that the federal courts are powerless to intervene, are unconscionable.”

Long day yesterday and today so wasn't focused on current events. That said, once caught up, holy cow.

Many voices expressed concern that the wrongly deported migrant, Kilmar Abrego Garcia, is already dead. I'm hoping not. Of concern I read that the FOTUS admin is cancelling, yes, cancelling Social Security numbers legally obtained by migrants to pay their taxes. Captain Obvious statement here but if they can cancel their numbers they can cancel you too.

Seriously whomever is giving the FOTUS admin their One Great Hack accounting tips needs to face some serious consequences. "I know how to make the Social Security Admin fiscally sound - delete most of the client base!!!!" I keep hearing in the back of my brain. Scarier are those who listen to such twaddle (I hear it, I do not 'listen').

So much damage done to our institutions but (and I'm going to bang this drum until the vision is reality) what WeThePeople had wasn't working. How do I know? Please, I'm observant and there wasn't one person who looked forward to their interactions with any of our agencies, even when the outcome was favorable. That's how I know.

Our antiquated were built for and by the patriarchy. They all need some modernization to meet the needs of WeThePeople as we exist here/now not as an ideal from 80 years ago. I suggest crowd sharing for ideas, idea balloon their thoughts into most popular/most mentioned, and keep refining the ideas until we have the columns/institutions upon which WeThePeople rebuild our country. It's project planning 101. Might have been a fan back in the day.

I'm glad certain SCOTUS members looked beyond the end of their nose to see the writing on the wall. All this theater is more than just the fate of one wrongly deported soul. It's a power grab, a test to see how far the FOTUS admin can push without getting pushed back. Scary times indeed.

Sending loves all your way - even the trolls. Universal love is universal. And no skud, Universal love is not the same as Free Love. Trust you to go sexual when no sex was mentioned.

Not so fast. The SCOTUS merely decided not to overturn the ruling by the District Court. One word they used was "effectuate" the return. Now the Admin will go back to SCOTUS and ask for clarification in their ongoing attempt to drag this out.

Yes, it was 9-0, but also unsigned.

We still need to wait and see. The Pres of El Salvador will be coming to Washington next week. If they really wanted to make a statement, they would have said we expect him on the plane when it lands.

They could have, but they did not.

House, Senate, Courts - now he is bullying law firms. Next it will be hobby shops, fast food and nail salons. Glad he's old, over weight and full of bile.

Dave Miller, The Supremes did kick the issue back down to the lower court. After some word play shenanigans by the FOTUS Press Sec on the word effectuate the presiding Judge called them on it, delivered in plain language that they will deliver the person posthaste and then requested the FOTUS admin to keep them in the loop. We are supposed to have an update today I believe as the courts involved are a seven day a week operation. From the language of the order it appeared they no longer are 'playing games'. From Glenn Kirschner's perspective Contempt of Court is on the table.

I might have been listening to Brian Tyler Cohen to be this knowledgeable. He and his partners have provided clarity where fog existed before.
