Read the Gorsuch opinion... in it he simply calls out the dissenting judges in this case. Why? Because they, like the rest of MAGA land, have no consistency of belief and change their 'legal views" depending on who is in office.
How else to explain, he asked, why Justices Thomas, Alito and Kavanaugh, who all cited the "major doctrine precedent" to shut down Biden actions, essentially denied it even existed in a similar case of POTUS overreach involving Trump.
Justice Kavanaugh argued in his dissent one of the reasons to not end what Gorsuch called the "illegal" and "unConstitutional" Trump tariffs that “The United States may be required to refund billions of dollars to importers who paid the IEEPA tariffs, even though some importers may have already passed on costs to consumers or others.”
What the heck kind of SCOTUS argument is that? It's not a legal argument from the Constitution at all. It's as if a Justice was arguing abolishing slavery would lead to economic crises, so we should not do it.
Kavanaugh should be impeached for such a specious argument and together with Thomas and Alito, ashamed to call themselves Justices of the SCOTUS.
It should have been a 9-0 decision, sending tariffs back to Congress, where they belong, except in a real emergency.
If not stopped in its tracks MAGA will eventually recreate the Third Reich in America.
The flavor and nuances wil be different but the results essentially the same. Tyranny of the Minority in pursuit of great benefit for the few.
