Under current law, a president cannot unilaterally send the National Guard into a state like Illinois against the governor's will, except under specific and limited circumstances defined by the Insurrection Act of 1807. This law restricts the president's ability to use military forces for domestic law enforcement.

 The president does not have absolute authority over a state's National Guard. According to federal law, including the Insurrection Act, a president can only deploy the National Guard to a state without a governor's request or consent under specific conditions. 

Legal experts have stated that using the Insurrection Act to intervene in local crime is a stretch of presidential authority. 

Governor J.B. Pritzker of Illinois has also spoken out against potential federal troop deployments to Chicago, emphasizing that no emergency has warranted such a move.
