"...The stench of partisanship on the Court..."

Does a Supreme Court justice wife's support of Donald Trump and his "Stop the Steal" seditionist marchers on the Capitol compromise that justice? The Court?

Imagine if this were a wife of a Supreme who publicly advocated for BLM or Antifa. 

How would the Trumpublicans feel about that?

"The claim that the Justices’ opinions are politically neutral is becoming increasingly hard to accept, especially from Thomas, whose wife, Virginia (Ginni) Thomas, is a vocal right-wing activist. She has declared that America is in existential danger because of the 'deep state' and the 'fascist left,' which includes 'transsexual fascists.' Thomas, a lawyer who runs a small political-lobbying firm, Liberty Consulting, has become a prominent member of various hard-line groups. 

Ginni Thomas’s political activism has caused controversy for years. For the most part, it has been dismissed as the harmless action of an independent spouse. But now the Court appears likely to secure victories for her allies in a number of highly polarizing cases—on abortion, affirmative action, and gun rights. 

Many Americans first became aware of Ginni Thomas’s activism on January 6, 2021. That morning, before the Stop the Steal rally in Washington, D.C., turned into an assault on the Capitol resulting in the deaths of at least five people, she cheered on the supporters of President Donald Trump who had gathered to overturn Biden’s election. In a Facebook post that went viral, she linked to a news item about the protest, writing, 'LOVE MAGA people!!!!'

Shortly afterward, she posted about Ronald Reagan’s famous “A Time for Choosing” speech. Her next status update said, “GOD BLESS EACH OF YOU STANDING UP or PRAYING.” 

Two days after the insurrection, she added a disclaimer to her feed, noting that she’d written the posts 'before violence in US Capitol.' (The posts are no longer public.)"

"Stephen Gillers, a law professor at N.Y.U. and a prominent judicial ethicist, told me, 'I think Ginni Thomas is behaving horribly, and she’s hurt the Supreme Court and the administration of justice. It’s reprehensible. If you could take a secret poll of the other eight Justices, I have no doubt that they are appalled by Virginia Thomas’s behavior. But what can they do?' ”

Thomas has been violently anti-Democratic for a long time. She has hated Biden since Anita Hill. Spousal affiliation has never gotten far with politicians, so Thomas's comments will be absorbed.

Is Ginni an influence on Clarence as it regards Trump and the insurrectionists?

Maybe, maybe not.

But we can look at decisions from the SCOTUS since 2000 and there have been darn few 8-1 decisions. Because a single dissenting judge has to believe that he or she is right and every other justice is wrong on the law.

How likely is it that one justice can't find even one other colleague to agree?

I think the point of the Mayer article is that Ginni Thomas's political involvement with Trumpers and Trumpism gives the "appearance" of partisanship, and that is not acceptable for the Supreme Court. She's the only wife or spouse one hears about involving her partisan activities. If you read the article, you'd read that her husband states he relies on her for her opinions and input on various matters. How can we be sure he's not influenced by her rabid Trumpism? In fact, his was the only dissenting vote on the case before the Court which decided against Trump in his attempt to stop the Congressional committee investigating J6 from the archives. Now I'm wondering why HIS was the only dissenting voice.

It's not a good look for the Court. Can you imagine the outcry if a spouse of a Supreme was loudly giving support to BLM or any far left organization, let alone one that tried to stop the certification of the electoral count!!!!

The right wing blogsphere and FAUX NOOZ would be yammering about it for years!!!!!

Here's the famous proverb on "Caesar's wife" that I meant to include:

Caesar's wife must be above suspicion proverb: "If one is involved with a famous or prominent figure, one must avoid attracting negative attention or scrutiny."
