A Deliberate Flouting of the US Constitution

Take a few moments out of your life and read this account of what has happened to the life of Kilmar Abrego Garcia. Garcia is one of the 260 [we cannot be sure how many because the Trump Administration does not have firm numbers themselves.] or so suspected gang members the administration recently deported to a penal colony in El Salvador.

Last night, Nick Miroff of the Atlantic reported that Trump administration lawyers admitted, in a court of law, that immigration officials mistakenly deported an individual with protected legal status to El Salvador’s “Terrorism Confinement Center.”


Kilmar Abrego Garcia fled gang threats in his native El Salvador in 2011, when he was 16 years old, and came to the United States. He has lived here since, has no criminal record, works full time as a union sheet-metal apprentice, is married to an American citizen, and is the father of a five-year old child who is a U.S. citizen. He was accused by an informant of being a member of MS-13, which his lawyer has strenuously denied and for which there seems to be no proof. He was never convicted of or even charged with any crime.


In 2019, Abrego Garcia filed an application for asylum and an immigration judge granted him legal protection from being sent to El Salvador based on legitimate fears of persecution and torture.


The [Trump] administration admits in its court filing that it “was aware of this grant of withholding of removal” at the time it violated that court order and sent Abrego Garcia off to prison in El Salvador anyway.


And yet, the administration now claims that there is nothing a U.S. court can do to rectify their willful mistake.

The Trump Administration, with full knowledge and forethought, deported a known innocent man, after depriving him of his Constitutional rights. Further, the Trump Administration  was aware that this innocent man had a legal “grant of withholding of removal.”


And now the administration claims there is nothing they can do to rectify the situation.


Oops, so sad, too bad.


Not a single GOP leader has spoken up to condemn the administration for this obvious miscarriage of justice and violation of the Constitution. Nor have many leaders from the Democratic Party.


Certainly not one member of the administration is resigning over this and not one of them is expressing remorse.


Joe Biden, Barack Obama, indeed all of our presidents have made mistakes. Then they’ve admitted wrongdoing, apologized and helped our country make amends. Perhaps Ronald Reagan apologizing for Irangate and the Japanese internments during WWII, comes to mind. 


I have to say, way too often these days, that I’ve never seen anything like what has happened to Garcia in my lifetime from a US Presidency.


I’ve also never seen the indifference from so many everyday US citizens before. 


Maybe we’ve just become too inured to the everyday chaos, ugly reality and violence that is the Trump Administration to notice… or care.


I sure hope not.

We got what the anti democracy MAGA clowns aspired to. Unfortunately the apathy of many in America (democrats and independents) who didn't vote, or pulled the trigger for tRump because they woudn't vote Harris bear responsibility for the current Abortion Administration of the country's first Felon president as well.

This ain't gonna end well for anyone. Don't believe it MAGA? And apathetic dems and independents? Try reading some world history. Focus on 1920 through 1945.

Unless and until the party of the Felon and the scotus grow a pair this nation is royally screwed.

A Maryland father with legal status, on his way to pick up his autistic son, was seized by ICE and deported. No hearing, no charges, no judge—just shackled and disappeared into a Salvadoran mega-prison, indefinitely.

@RepRaskin explains: This is what happens when due process is cast aside. The Trump Administration trampled the Constitution, admits to their mistake, and now claims the man’s fate is out of their hands.

Those of us who've been banging the Hey, What's Happening Here drum knew this was coming. I've been reading stories all day, specifically that ICE scooped up a 'brown' person who turned out to be a citizen. Oops.

Also reading about ICE folks not quite getting the memo that Navajo folks don't have the same papers as citizens of that state AND THAT'S OK BECAUSE THEY WERE HERE FIRST and they have their own sovereign nation identification. Holy crap on a cracker, and I thought the comments here were off the wall. Oh the feeling as I gazed upon the look on the ICE officers faces - yeah, someone skipped a class or two when the the history of the area was the topic. And universally, no one likes to be called on the carpet in front of the press. Epic fail.

Bright note - Crawford won her race for Wisconsin Supreme Court. It's been noted that this election was perceived as a litmus test on how well the FOTUS admin's agenda is viewed.

I guess they have their answer.

Anon, BB, Shaw and Grey... notice how not one of our conservative MAGA supporting commenters, nor any of the crazy trolls, have stopped by to offer a positive defense of the actions of the Trump Admin in ignoring the Constitution in the El Salvador deportation operation?

Nor will you see those defenses anywhere else online either.

They know Trump, VP Musk and their team is wrong on this. They know it in their hearts, they know it in their minds. But they are unable to post on it, defend it and outwardly support it.

Because to do so, they would have to admit they were wrong and they've support a president who currently is openly debasing the Constitution.

And we all thought they cherished the founding documents of the US.

Taking a deeper dive, clearly the Trump Admin is on the wrong on this issue.

Big MAGA backer and podcaster Joe Rogan, the most listened to guy in America these days announced on his show the other day that Trump and his admin is wrong on this issue. Here's his quote...

“The thing is, like, you got to get scared that people who are not criminals are getting, like, lassoed up and deported and sent to, like, El Salvador prisons...”

You would think YES, that's exactly right. But many on the conservative MAGA side default to the "you need to crack a few eggs to make an omelet" defense, excusing a few constitutional mistakes for the "larger good" of deporting the "illegals".

But that's the point isn't it?

We need to support and defend the Constitution even when it's hard, even when we do not like the reality and ramifications of it. Rogan gets it. The sailors and deck mates on the Mothership? The conservative internet radio hosts and you tubers?

Doubtful.

Even Ann Coulter got it right, commenting on the Trump Admin deporting legal immigrants because they did not approve of those immigrants having a different opinion. Here's her quote...

“There’s almost no one I don’t want to deport, but, unless they’ve committed a crime, isn’t this a violation of the first amendment?”

Such a novel idea isn't it?

You deport a crime, you get deported. That's Constitutional. You have a different, maybe even anti Trump opinion, you get to stay. That's Constitutional too.

Unless you're an extreme MAGA clown who we've now seen, does not support the Constitution, despite all their blather and former military bravado to the contrary.

The best part of the Wisconsin win is that it was so decisive and Elon wasted his money. "Can't buy me love," is changed to "Can't buy me votes!" LOL!

Dave, Do we really know enough about this one individual to know what the truth is. If you listen to the MSM he is perfect and if you listen to the administration he is a criminal. Maybe instead of going off the rails you should pause until you have the correct facts but I realize it is trump and the maga crowd so they must be guilty.
Maybe if the previous administration hadn't opened the border and let millions in we wouldn't have to throw out so many criminals.

skud, we KNOW enough about Kilmar Abrego Garcia because the Trump regime said they made a mistake in sending him to El Salvador. So that means Mr. Garcia was NOT a criminal, since the Trump regime told Americans that ONLY the undocumented who have criminal records would be sent to prison.

The Trump regime, IMO, is a criminal operation, since Mr. Garcia and all the others who were swept off the streets of America and sent to a notorious prison in a foreign land were supposed to have DUE PROCESS as is guaranteed in the Constitution.

Anything else you have to say is unimportant until you at the very least admit that we are being ruled by an outlaw government, led by a felon and sexual assaulter.

Just today, Trump's lawyer, Pam Bondi, had all the charges dropped against New York mayor Adams. Why did they do that? It was a slap in the face of Lady Justice and an insult to anyone who cares for the rule of law. This was, plain and simple, a quid pro quo.

Ponder this: We had a man who broke no laws, a husband and father, kidnapped of the street of an American city and flown to a foreign country to be jailed at a notorious prison WITHOUT DUE PROCESS which is demanded by the U.S. Constitution for EVERYONE WITHIN OUR BORDERS, LEGAL, NON-DOCUMENTED, INNOCENT OR GUILTY. It is one of the tenets of our law that makes America a shining example for the rest of the world.

And just today, the Trump regime had corruption charges against the mayor of New York dropped because Adams had promised to cooperate with the Trump regime during the dragnetting of legal migrants and undocumented people.

We’re no longer in right vs. left, MAGA vs. liberal, Republican vs. Democrat terrain.

For us ordinary Americans, the choice now is the Constitution and rule of law vs. unchecked abuses of government power that target anyone who opposes the Trump-Musk-Vance regime.

We Americans once again must fight to defend what made America a land of innovation, opportunity and prosperity: freedom of speech and assembly, a free press, the rule of law and due process, and three equal branches of government of, by and for the people.

NO. MORE. Trump and his corrupt lackeys have ruined our system of laws.
