Idaho Lawmakers Want Supreme Court to Overturn Same-Sex Marriage Decision

A state legislative committee has advanced a resolution asking that the power to regulate marriage be returned to the states.

“What is the purpose of this exercise?” said Mistie DelliCarpini-Tolman, the Idaho director for Planned Parenthood Alliance Advocates, who lives with her wife not far from Boise. “It really feels like a value statement being sent to the L.G.B.T.Q. community in Idaho that they are not welcome.’’

Can anyone tell me how the private lives of same sex couples who marry affect other people's marriages?

This is nothing but naked hatred toward the LGBTQ+ community, who certain Christians in Idaho wish to terrorize and harm.

Leaving marriage equality to the states will cause chaos, since the MAGA states would immediately invalidate same sex marriages within their states, disrupting lives and even putting children's lives in jeopardy. And the states that do not recognize marriage equality would not allow same sex couples who've married in states where it is legal, to legally reside in their states, should those couples need to move for employment or family reasons.

Chaos. All of this created to menace and harass the LGBTQ+ community!

And that is pure EVIL!

This attack on Americans' marriages will probably go nowhere.

I'm guessing the miserable people in Idaho who are advancing this anti-LGBTQ+ proposal will not ask the SCOTUS to overturn Loving vs. Virginia which, in 1967, made interracial marriage legal throughout the U.S. That would affect Justice Thomas's marriage, and the hypocrites wouldn't want to disrupt their happiness, would they?

Evil and hate now rule America.

Let's step away from the LGBTQ debate for just a moment and think on this...

Prior to 1967, 16 states in the US still held it was illegal for people like me and my wife to be married. Why? Because we were from different races. And those rules, or laws, under the doctrine of states rights, were there primarily because of Christians and a wrongly held biblical belief.

For years, actually centuries, many Christians felt the Bible prohibited interracial dating and marriage and codified those beliefs in our laws.

Until 1967.

The Obergefell SCOTUS decision, which gave the LGBTQ the right to marry whomever they wanted, and have those marriages respected and accepted as lawful unions around the US, just like my marriage, was based on the precedent of Loving v Virginia.

Is Idaho challenging the SCOTUS Obergefell decision, as Justice Thomas moronically advocated in Dobbs? What is Rep Heather Scott of Idaho trying to say?

Does the Loving decision only apply to certain people? Or does it apply to all people? Do the feds have a right to play a part in regulating marriage across the land and do states have a right to choose to accept, or not accept a marriage from another state?

Do interstate commerce laws completely prohibit discrimination in all states, or only prohibit it against some, in some states?

Once again, clueless politicians seeking cultural wins and a chance to own the libs, needlessly put forth bad laws for personal gain.

Nice job Idaho.

BB... any thoughts?

No one has been able to explain to me how a happily married gay couple's marriage affects ANYONE's marriage.

If it is a matter of the straight couples' religious beliefs , that doesn't make sense, since the religious straight married couples aren't going against their religious tenets when gay couples are married.

If it's a matter of the straight couples wanting to impose their religious beliefs on everyone, then that is not allowed by law in America -- so far.

Why can't people just MYOB?

PS. Aren't there instances in the Bible where one man has more than one wife? Abraham?

I should be outraged at Idaho republicans and no doubt many legislatures will follow their lead. But I'm most bemused by the apathetic that don't bother to vote. Even more so at the voters that since Reagan have voted virtually entirely against their interests. The self deluded fools that ridiculously believed a vote for Ralph Nader or the Green Party candidate would send a message to the Democrats. The Democrats have been the party for working Americans since FDR. They've been the party for civil rights, for workplace safety. For right to unionize. For earned income credits to ease the tax burden and help lower wage families. Yet I hear the same shit from people every time somebody finds out I'm a Democrat. What have they done for me? Quite frankly Shaw, any person in the group's mentioned in this thread that either didn't vote or voted for a fringe candidate can fuck off. You're getting what you deserve. Federal law supercedes state law. Look what happened to abortion rights. More is coming. I hope the outliers, or whatever name doesn't offend these folks, realize this before the mid terms. History says Dems will take one of the houses back. We need more than the few seats history shows the minority party will win. Pardon my french, should more than the Progressive Eruptions fans see this, but wake the fuck up people. Or Trump will have four years to destroy the freedoms it took our Nation from 70 to 200 years to recognize. Plus name his successor with a simulated election Putin would be proud of.

Marry who you love... the individual right to do so.

What does the RCC say on the matter. I stepped listening to its drivel years ago.

Same for Evangelicals.

Your right JoBama, but, 1) times have morphed into insanity, 2) If the midterm flips one our both houses, well, the BSFp will insure he finds enough fraud to investigate and low and behold the votes to keep both houses facist will materiaize.

Count on it.

OT but same crap

The narcissitic BSFp has fired folk at the now Department of Propagada, formerly the DOJ.

I's playing out exactly as thinking people knew it would.

There's strength in numbers and if everyone who knows what the BSFp is stood up and resisted in any way they can there wouldn't be enough prisons to house 80 million people who do not share his filthy narcissistic fascist idealogy.

Marylanders voted for same sex marriage in a referendum that legalized it before Scotus got involved. We )prefer to change laws legislatively rather than backwards/ judicially (ala Massachusetts). ;

The Mass. Supreme Judicial Court interprets its state laws, just like the SCOTUS interprets laws brought before it and determines whether or not they are constitutional.

Maryland passed its legislation allowing same sex marriage 10 years after the Mass. Supreme Court ruled it was constitutional (May of 2003) and 6 years after the Mass. legislature enacted it into state law(2007). By then, other states were falling in line and legally recognizing same sex marriage.

Anyway, what's your point? Lincoln did not end slavery nationwide with the January 1, 1863, Emancipation Proclamation, which applied only in the Confederate States. Slavery was outlawed by the 13th Amendment in April of 1864.

Sorry, late to the party. Traffic was crazy. Really, humans are losing their brains and driving has been, well, let's just call it exciting. No accidents on my watch thus far but yikes, the number of humans ignoring lights because they are just suggestions? Near misses aplenty.

Shaw asked an entirely reasonable question as how two humans from the LGBTQIA+ community having the right to marry affects the one man one woman marriages from tradition.

Tradition - carries a lot of weight with more implications than definitions.

This was my fight back in the day and tradition was defined as 'biblical' until us clever Ghayz pointed out (helps that we've read the book used to condemn our community) that traditional marriage in the Christian Holy book had waaaaayyyy more variations in regards to marriage than just one and one. So the goalposts moved and traditional was suddenly just one man one woman end of argument because reasons.

Which is why when the case moved up to the Supreme Court the right to marry became the law of the land. All the opposition had was innuendo (next humans will be marrying their lawn mower or their dog - both events happened - I think - but neither were part of the LGBTQIA+ community. Consent matters) and the LGBQIA+ community had facts, data, and really good lawyers.

Now since the Nat C's are in power the old arguments have bubbled up. Thing is though the Overton Window has shifted. All the predictions of gloom and doom never happened. Instead hard hearted bigots who'd abandoned their kids, not all but a significant number, reconciled. Grandkids are a powerful motivator. So is happiness and all most parents want for their kids is for them to be happy.

I'm thinking the Nat C's and President Felons cabinet waited too long to release their evil plan. Seriously - they've been working toward this for over two decades, got their chance but miffed the extra point? Yes, everything the Felon touches dies. Project 2025 and the Nat C's and Tech Bro's will learn that soon enough, but not before trashing the place. Echoes of Jan6. Hopefully they won't spread too many feces on the walls.

The Idaho legislature contains 59 creeps/11Dems -the Senate has 28 creeps and 7 Dems. Otherwise it is a beautiful piece of the Rockies. If, as der Leader
suggests, they divert our water to CA, even our creeps will reverse course.

Grey... "facts, data and really good lawyers."

Sounds like what Bernard Cohen, the lead lawyer on Loving v Virginia brought to the table in that case. But as we've seen from from -FJ, Skud and a lot of the other more conservative folks here, facts and data are not their strong suit.

Innuendo, unsupported claims, feelings, scapegoating and You Tube research seem to rule their days.
